Sponsor
United Way of the Greater Lehigh Valley with an office located at 1110 American Parkway NE, Allentown, Pennsylvania 18109 (“Office”) is the sponsor (“Sponsor”) of the United Way Campaign 2023 Incentive Program (the “Incentive Program”). The Incentive Program is to encourage contributions to Sponsor’s 2023 fundraising campaign (“Campaign”). Brown-Daub, Wegmans, BSI Corporate Benefits, and C.F. Martin & Co. (“Prize Partners”) have partnered with the Sponsor to provide the Incentive Program Prizes.
Entry Period
The entry period ends on January 31, 2024 at 11:59 pm (ET) or may be extended or shortened in Sponsor’s sole discretion (“Entry Period”). Sponsor will be the official timekeeper for the Incentive Program.
Eligibility
Subject to the additional restrictions of these Official Rules, eligible participants of the Incentive Program must be legal U.S. residents, 18 years of age or older, who contribute at least $365/year to the Campaign with a second entry for increasing their contribution to the Campaign by at least $100 or more from their 2022 pledge, and submit an Entry. Employees or board members of Sponsor or Sponsor’s parent, subsidiaries, and affiliated companies, and the immediate families or members of the same households of such individuals are not eligible for any of the Prizes. Employees or board members of Prize Partners or Prize Partners’ parents, subsidiaries, and affiliated companies, and the immediate families or members of the same households of such individuals are eligible for all of the Prizes except the prize which is sponsored by their own company. The term “immediate families” includes spouses, parents, siblings, children, and step-relations. Proof of age, identity, insurance, and the other eligibility criteria must be furnished to Sponsor upon request. Sponsor will not award Prizes to anyone not meeting eligibility requirements. Sponsor reserves the right to disqualify any entrant if these Official Rules are not followed. Prizes are non-transferable. All information in the Entries must be complete and accurate.
How to Enter
All Entries must be received during the Entry Period. Each person contributing to the Campaign who wishes to be entered into the Incentive Program must complete a Sponsor pledge form entry or Workplace Giving Portal online pledge form entry (“Entries”). Entries must include the person’s name, address, telephone number, amount of contribution and signature. Incomplete, forged, altered, lost, and/or late Entries are void. All Entries become property of Sponsor and no Entries will be returned.
How to Win
The winners will be selected through a random drawing (“Drawing”) from the Entries. A Drawing will take place for each of the Prizes. The Drawing will be held following the close of the Campaign and the names of each of the winners will be announced soon thereafter. Each of the winners will be notified by telephone or certified mail immediately following verification of the winner’s contribution of their pledge at the phone number or address provided on the potential winner’s Entry. Proper identification will be required upon presentation of one of the Prizes. A potential winner does not need to be present at the time of the Drawing to win one of the Prizes. If Sponsor is unable, after making a reasonable effort to contact a selected potential winner based on the contact information provided on the Entry then that potential winner will be disqualified and a new potential winner will be selected from remaining Entries. A winner will be disqualified and an alternate winner may be selected by random drawing from among all remaining Entries if a winner does not fulfill the eligibility requirements or if a winner does not adhere to the Official Rules. Winner hereby agrees that he or she will sign and return any appropriate or required forms and/or documentation relating to the transfer of a Prize. Failure to execute such documentation will result in that winner being disqualified, and Sponsor may randomly draw another winner from among all remaining Entries.
Publicity Release
Except where prohibited, entry in the Incentive Program constitutes each entrant’s consent to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television, radio, or offline promotions), the winner’s name, city, photograph, likeness, biographical material, voice, image, each in perpetuity without further compensation, credit or right of review or approval.
Prize
There will be one winner for each of the following prizes; the grand prize is $10,000 in cash, the first prize is $2,500 worth of gift cards to Wegmans (“first prize”), the second prize is a Lehigh Valley IronPigs Dugout Suite (“second prize”) and the third prize is a Martin Guitar (“third prize”) valued at $1,799 courtesy of C.F. Martin & Co. (collectively the “Prizes”). No other Prizes are part of the Incentive Program. Limit one Prize per individual. Sponsor assumes no liability or responsibility in connection with the safety or performance of the Prizes awarded hereunder nor in connection with any warranty or representation therewith. Prizes may not be redeemed for cash. No substitutions of the Prizes by a winner are permitted. Sponsor reserves the right to substitute a prize of equal or greater value for any reason in the sole discretion of Sponsor if one of the Prizes is unavailable for any reason. In no event will Sponsor award more prizes than are provided for in these Official Rules.
Fees and Charges
The winners are responsible for all federal, state and local taxes on the Prizes. All charges, fees, taxes, insurance, transfer fees, and other costs are the responsibility of each winner. All expenses not specifically provided for herein are the responsibility of each winner.
Odds
Odds of winning depend upon the number of eligible Entries received during the Entry Period.
Participation
By entering the Incentive Program, you agree to comply with all applicable laws and these Official Rules and agree to abide by all decisions of the Sponsor which are final and binding in all respects regarding this Incentive Program. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Incentive Program as solely determined by Sponsor. In the event the Incentive Program is compromised by tampering or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Incentive Program, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Incentive Program. Should the Incentive Program be terminated prior to the stated expiration date of the Entry Period, Sponsor reserves the right to award the Prize based on the Entries received before the termination date. Proof of sending or submission of an Entry will not be deemed proof of receipt by Sponsor. Any attempt by an entrant or other party to tamper with the proper administration of the Incentive Program will disqualify the entrant and may result in civil or criminal action against the entrant or other party and may result in the discontinuation, suspension, or cancellation of the Incentive Program
Limitation of Liability
Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Official Rules, and by entering, participants agree to be bound to these Official Rules. ENTRANTS AGREE, EXCEPT WHERE PROHIBITED BY LAW, TO RELEASE AND DISCHARGE, HOLD HARMLESS AND INDEMNIFY THE SPONSOR, AND THE PRIZE PARTNERS AND THEIR PARENTS, SUBSIDIARIES AND AFFILIATES (THE “SPONSOR ENTITIES”), THEIR EMPLOYEES, AGENTS AND REPRESENTATIVES, OFFICERS AND DIRECTORS AND THEIR IMMEDIATE FAMILIES, SUCCESSORS AND ASSIGNS, AND ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF THIS INCENTIVE PROGRAM, FROM ANY AND ALL TAX LIABILITY THAT MAY BE IMPOSED OR ASSOCIATED WITH RECEIPT OR USE OF THE PRIZE, AND FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, PROCEEDINGS, AND LIABILITY FOR ANY DAMAGES INCLUDING PROPERTY DAMAGE, EXPENSES, FEES, INJURY OR LOSSES (INCLUDING PERSONAL INJURY OR DEATH) SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP, OR USE OF THE PRIZE OR WHILE TRAVELING TO, PREPARING FOR, OR PARTICIPATING IN ANY INCENTIVE PROGRAM-RELATED OR PRIZE-RELATED ACTIVITY. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules or the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. Sponsor reserves the right to prohibit any entrant from participating in the Incentive Program if, at its sole discretion, Sponsor finds such entrant to be tampering with the Entry process or the operation of the Incentive Program, or if such entrant repeatedly shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsor; or (c) in any other disruptive manner. Prize may be considered income, and any and all taxes associated with the Prize are the responsibility of the winner. Each winner will be required to sign a release and hold harmless agreement in favor of the Sponsors and the Prize Partners and their respective agents and employees.
Disclaimer
Sponsor Entities, their employees, agents and officers, advertising and promotion agencies, and all others associated with the development and execution of this Incentive Program are not responsible for: (1) typographical errors in any materials relating to the Incentive Program, administration of the Incentive Program, or in the announcement of the Prize; (2) lost, damaged, mutilated, stolen, misdirected, illegible, incomplete, or delayed Entries; (3) cancellations, postponements, or delays; or (4) Acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or other similar causes beyond the control of the Incentive Program Entities, advertising and promotional agencies and their immediate assigns, making it inadvisable, illegal, impossible, or impractical to continue the Incentive Program or to perform under these Official Rules.
PRIZES ARE PROVIDED “AS IS”. SPONSOR MAKES NO WARRANTY, GUARANTEE, OR REPRESENTATION OF ANY KIND CONCERNING THE PRIZES, AND SPONSOR SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY
Arbitration / Choice of Law
Except where prohibited, entrants agree that any and all disputes, claims and causes of action arising out of or connected with this Incentive Program shall be resolved exclusively by arbitration pursuant to the rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by entrant with regard to this Incentive Program, but in no event attorneys’ fees, punitive, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Incentive Program shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Pennsylvania. Lehigh County shall be the exclusive forum for any dispute relating to these Official Rules and/or this Incentive Program. All participants and winners agree, by their participation in the Incentive Program, to submit to personal jurisdiction in Lehigh County.
Severability
The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
Official Rules
Sponsor reserves the right to change, alter, or amend these Official Rules as necessary, in its sole discretion, to ensure the fair administration of the Incentive Program or to comply with applicable law.
